Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of SkyRoof's website, products, and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
"SkyRoof," "we," "our," or "us" refers to SkyRoof and its affiliates. "You" refers to the individual or entity using our Services.
Description of Services
SkyRoof provides satellite-based roof measurement tools that allow users to estimate roof dimensions, calculate material quantities, and generate cost estimates. Our Services are intended for informational and estimation purposes only.
Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information as needed
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use
You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Services for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Services
- Reverse engineer, decompile, or disassemble any part of the Services
- Use automated means to access the Services without our permission
- Resell, redistribute, or sublicense the Services without authorization
- Use the Services to compete with SkyRoof or build a competing product
- Transmit viruses, malware, or other harmful code
- Harass, abuse, or harm others through use of the Services
Measurement Accuracy Disclaimer
IMPORTANT: Roof measurements provided by SkyRoof are estimates based on satellite imagery and user input. While we strive for accuracy, measurements may vary from actual on-site measurements due to factors including:
- Satellite image quality and resolution
- Roof complexity and geometry
- User drawing precision
- Image age and property changes
SkyRoof measurements are provided for estimation purposes only and should not be used as the sole basis for construction, insurance claims, or binding contracts. We recommend verifying measurements on-site for final quotes and contracts.
Payments
Single Pass
SkyRoof operates on a pay-per-use model. Each Single Pass is a one-time purchase that grants you one roof measurement locked to a single address. By purchasing, you authorize us to charge your payment method for the pass fee. Prices are subject to change with 30 days' notice.
Refunds
Single Pass fees are generally non-refundable. However, if you believe you are entitled to a refund due to service issues, contact us at billing@skyroof.io and we will review your request.
Intellectual Property
The Services, including all content, features, and functionality, are owned by SkyRoof and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Services without our express written permission.
You retain ownership of any content you upload or create using the Services (such as saved estimates). By using the Services, you grant us a limited license to store and process your content as necessary to provide the Services.
Third-Party Services
Our Services integrate with third-party services including Google Maps Platform and Firebase. Your use of these features is subject to the respective third-party terms and policies. We are not responsible for third-party services.
Privacy
Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your information.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or secure; that defects will be corrected; or that our servers are free of viruses or harmful components.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYROOF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
Our total liability for any claims arising from the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless SkyRoof and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
Modifications to Services and Terms
We reserve the right to modify or discontinue the Services at any time without notice. We may also update these Terms from time to time. Material changes will be communicated via email or through the Services. Continued use after changes constitutes acceptance of the updated Terms.
Termination
We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive.
Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Delaware.
General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and SkyRoof regarding the Services.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Our failure to enforce any right does not constitute a waiver.
- Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations freely.
